KG ("Productivity Boost," "we," "us," or "our"). By accessing or using GOLDEN, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Application.
Subject to your compliance with these Terms, Productivity Boost grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Application for your personal or internal business purposes. You may not copy, modify, distribute, or create derivative works based on the Application without our express written permission.
To the fullest extent permitted by law, Productivity Boost shall not be liable for any direct, indirect, incidental, consequential, or special damages, including but not limited to damages for loss of profits, loss of data, or business interruption, arising out of or in connection with these Terms or your use of the Application, even if we have been advised of the possibility of such damages.
You agree to indemnify, defend, and hold harmless Productivity Boost, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or in connection with your breach of these Terms, your User Content, or your use of the Application.
We reserve the right to modify or update these Terms at any time and for any reason. We will notify you of any changes to the Terms by posting the updated Terms on our website or within the Application. Your continued use of the Application after the effective date of the updated Terms constitutes your acceptance of the updated Terms.
We may terminate or suspend your access to the Application, with or without notice, for any reason, including but not limited to your breach of these Terms. Upon termination, you must immediately cease using the Application and delete any copies of the Application from your devices.
These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Passau, Germany.
